1. Acceptance of these Terms
These Terms of Service (the “Terms”) apply to your access to and use of the HIDAYA LONDON website and any related services provided through it (together, the “Service”). By using the Service, browsing any pages, or placing an order, you agree to be bound by these Terms.
If you do not agree with these Terms, you must not use the Service. You should also read our Privacy Policy, which explains how we handle personal data and cookies.
Minimum age: the Service is intended for users aged 16 and over. If you are under 18, you confirm you have permission from a parent or guardian to use the Service and place orders. If we become aware that an order has been placed without appropriate permission, we may cancel it.
2. Our service and scope
HIDAYA LONDON is a London-based women’s modest clothing brand. We curate and sell modest attire such as abayas, modest dresses (including fluid maxi silhouettes and kaftan-inspired styles), and co-ords and sets. We also provide non-binding style guidance through our customer support channels.
The Service includes product listings, collection pages, editorial guidance (such as trend and fabric information), and contact features. Any style advice we provide is based on the information you share and is intended as general guidance. It does not guarantee a particular look, fit, or outcome.
We may update product assortments, pricing, photography, and descriptions over time. We work to keep information accurate, but small variations can occur, for example due to screen colour settings, lighting in photography, or the nature of fabrics.
Nothing on the Service constitutes an offer that is binding on us. Orders are subject to acceptance, availability and verification as set out below.
3. Accounts, checkouts and communications
You may be able to checkout as a guest or through account features where available. You agree to provide accurate, complete and up-to-date information during checkout, including delivery address details and a valid contact email. This helps us deliver on time and resolve any delivery issues efficiently.
You are responsible for maintaining the confidentiality of any account credentials and for activity occurring under your account. One account per person is permitted. We may suspend or restrict accounts that appear to be shared, automated, or used for prohibited purposes.
If you contact us via Contact Us, you agree that we may respond by email or phone using the details you provide. We do not use support messages to send marketing unless you separately consent where required.
4. Orders, pricing and availability
When you place an order, you are making an offer to purchase items from HIDAYA LONDON. We may accept or reject your offer for reasons including stock availability, suspected fraud, payment issues, or errors in pricing or product information.
Prices are shown in pounds sterling (GBP) unless stated otherwise. Any applicable delivery charges and options are shown during checkout. We take care to display accurate prices, but errors can occur. If we discover an error after you place an order, we may contact you with the corrected price and give you the option to proceed or cancel.
Product availability may change, including after you place items in a basket. If we cannot fulfil an item, we will contact you and, where appropriate, refund the affected amount using the original payment method.
Promotions: from time to time we may offer promotions such as free UK delivery over a certain order value. Promotional terms may have conditions (for example, limited time, exclusions, or minimum spend). Unless expressly stated, promotions cannot be combined.
How orders are confirmed
You will typically receive an order acknowledgement by email after checkout. This acknowledgement does not mean the order has been accepted.
The order is accepted when we send a dispatch confirmation or otherwise confirm shipment. At that point, a contract is formed between you and HIDAYA LONDON for the items in the dispatch confirmation.
5. Delivery, risk and title
We deliver across the United Kingdom using delivery services that may include tracked options. Estimated delivery timeframes are provided during checkout or in dispatch communications, but they are estimates rather than guarantees. Weather, peak periods, and courier delays can affect delivery.
Delivery address: you are responsible for providing a correct delivery address and any required instructions. If an order is returned to us due to an incorrect address or failure to collect from a courier location, you may be responsible for additional delivery charges to resend the parcel.
Risk and title: the risk of loss or damage passes to you when the goods are delivered to the delivery address. Title to the goods passes to you when we have received full payment and the goods have been dispatched, unless otherwise required by law.
If your parcel arrives damaged, please notify us as soon as reasonably possible via Contact Us so we can help. We may ask for photos of packaging and items to support claims with carriers.
6. Returns and cancellations
We aim for a smooth shopping experience and want you to feel confident ordering modest fashion from our London base. If you need help with sizing or styling before you buy, please contact us for guidance.
Consumer cancellation: if you are a UK consumer purchasing online, you may have legal rights to cancel certain purchases within a “cooling-off” period. If applicable, you should notify us promptly and follow the returns instructions we provide. Items must be returned in an acceptable condition, with original tags and packaging where possible.
Hygiene and condition: for quality and hygiene reasons, some items may be non-returnable if they have been worn, washed, altered, damaged, or if hygiene seals are broken where applicable. If we receive a return that does not meet acceptable conditions, we may be unable to refund it.
Faulty items: if an item is faulty or not as described, please contact us. Your statutory rights are not affected.
Returns process: to organise a return or report an issue, use our Contact Us page. We will confirm the next steps and what information we need.

Check lengths and layering
Modest pieces are designed for coverage. Consider your preferred underlayers and footwear when choosing a maxi length.
Fabric matters
Crepe, chiffon and textured blends drape differently. If you prefer a structured look, ask our team for recommendations.

We will not change the meaning of your content and will respect reasonable requests to remove re-shares.
9. Disclaimer of warranties
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties and conditions, whether express or implied, including implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement, except where such disclaimers are not permitted for consumers.
We do not guarantee that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. You are responsible for using appropriate safeguards when accessing the internet.
Product information, including descriptions and fabric notes, is provided to support informed shopping. However, minor differences can occur due to manufacturing batches, colour representation on screens, and natural fabric variation.
10. Limitation of liability
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.
Subject to the above, to the maximum extent permitted by law, HIDAYA LONDON will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business interruption arising out of or in connection with your use of the Service or purchase of products.
Our maximum aggregate liability to you for any claim arising out of or relating to the Service or these Terms (including purchases) is limited to the lower of: (a) the amount paid by you to HIDAYA LONDON in the 12 months preceding the event giving rise to the claim, or (b) €100.
This limitation applies whether the claim is based in contract, tort (including negligence), strict liability, or any other legal theory, and whether or not we were advised of the possibility of such damages.
11. Indemnification
You agree to indemnify and hold harmless HIDAYA LONDON, and our officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your breach of these Terms.
- Your misuse of the Service.
- Your violation of any law or third-party rights.
We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, and you agree to cooperate with our defence.
12. Third-party links
The Service may contain links or references to third-party websites, tools, or services. We provide these links for convenience only. HIDAYA LONDON does not control and is not responsible for the content, policies, or practices of third parties.
Accessing third-party services is at your own risk. You should review their terms and privacy policies before using them.
13. Privacy
Our Privacy Policy explains how we collect, use and share personal data, including use of cookies and analytics. The Privacy Policy is incorporated into these Terms by reference.
If you submit personal data through the Service, you confirm you have the right to provide it and that it is accurate. Please do not share sensitive personal information via the contact form unless we specifically request it for a legitimate reason.
14. Governing law and dispute resolution
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by the laws of England and Wales.
Courts: subject to any mandatory consumer protections, the courts of London, England shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
Informal resolution first: before starting formal proceedings, you agree to contact us and allow a 30-day period to try to resolve the matter informally. You can reach us via Contact Us. Please include your order number (if relevant) and a clear description of the issue.
15. Termination
We may suspend or terminate your access to the Service (with or without notice) if we believe you have breached these Terms, misused the Service, or engaged in unlawful or harmful behaviour. We may also restrict access to protect the Service, our customers, or our business.
If your access is terminated, the following provisions will survive to the extent necessary: Intellectual property, Disclaimer of warranties, Limitation of liability, Indemnification, Governing law and disputes, and any other terms which by their nature should survive termination.
16. Changes to these Terms
We may update these Terms from time to time to reflect changes to the Service, our operations, or legal requirements. Updates will be posted on this page with a revised “Last Updated” date.
Unless a change must take effect immediately for legal or security reasons, changes will be effective 14 days after posting. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
